UK Government's approach to commercial rent arrears - the £7 billion question

With the pandemic causing an estimated £7billion of rent arrears, The UK Government has announced its plans for a mandated arbitration process. In its policy paper, released on 4 August 2021, it confirmed that legislation regarding the resolution of disputes surrounding Covid-19 rent arrears should be in place before the end of March 2022. As we wait for the draft legislation to be released, which is thought may be early this month (November 2021), our Real Estate Dispute Resolution team have put together some thoughts and predictions on what the rent arrears arbitration process could look like.
