Title Deeds new Regulations

The Minister of Rural Development and Land Reform has published new Regulations, dealing with lost or destroyed title deeds, which will commence on 25 February 2019.

The recent change governing the application to the Deeds Office for a duplicate original title deed (mortgage bonds, notarial bonds, registered leases, holder of real rights etc.) will involve extra delays and costs. The Application Affidavit will have to be “attested by a notary public” (a specialised attorney whose certification process carries more weight than a Commissioner of Oaths) and it must also be advertised in the Government Gazette and for 2 weeks after publication must lie open for inspection by the public at the Deeds Office.

Now is the time to confirm the whereabouts of your title deed and if it is lost make immediate application to replace it before D-Day arrives!
