Eversheds comment: Political Agreement on EU Data Protection Regulation at Last

Commenting on the news that political agreement has been reached on the new EU Data Protection Regulation, Marie McGinley, Partner and Head of Intellectual Property, Technology and Data Protection from Eversheds Ireland, says:

“A major milestone was reached this week in respect of the new EU Data Protection Regulation or GDPR. While it has yet to be formally adopted, it appears that an agreement may finally have been reached after nearly four years of discussions. It is likely that the GDPR will be adopted in the spring of next year. We have yet to see the final text to see if it contains any surprises. We await with anticipation the vote by the LIBE Committee of the European Parliament on Thursday, before both the Parliament and the Council then formally vote to adopt it. 

“This is an extensive piece of legislation which will have a significant impact on the way that businesses collect and process personal data.  Not just in the EU but also for those international businesses that trade with Ireland.  At a time when territorial reach is a hot topic in relation to US reach into the EU, these new rules will add another layer of complexity. The GDPR will apply to virtually any business that offers its products and services in the EU market.”
