Insolvency and restructuring

If an affiliate has become insolvent, the insolvency proceedings will rarely lead to a complete fulfilment of all obligations. Usually creditors must be content with a lower rate. Therefore we support our clients especially when it comes to the protection of their rights as creditors in ongoing proceedings, the enforcement of separation and recovery rights or the warding of claims of the bankruptcy trustee.

Even a temporary delay in payment may lead to the application for bankruptcy proceedings by an affiliate. But if the proceedings is once opened and disclosed, this fact can lead to unexpected and severe damages for a company – even if all obligations can be fulfilled later. In such situations, where swift action is absolutely necessary we support our clients by professional advice to find the best possible solution and may even avoid the opening of bankruptcy proceedings.
