New Swiss data protection law
Guidance for implementation in the company
The Parliament adopted the revised Swiss Data Protection law on 25 September 2020. The Federal Council issued the implementing ordinance for the Data Protection law on 31 August 2022 and set the date for its entry into force. The new Data Protection law will enter into force on 1 September 2023 without any further transitional period.
The new Data Protection law implements the European General Data Protection Regulation (GDPR), but differs significantly from it in certain areas. Corresponding organisational adjustments should be made. The rights of the persons concerned and the possibilities of sanctions in the event of incorrect processing of personal data must be implemented in the companies until the entry into force of the law. Corporate data protection must also be adapted to numerous other developments and new regulations, such as the discontinuation of the Privacy Shield Agreement, the Cookie Directive or the Digital Directive.
