E-commerce

Our e-commerce team spans our offices internationally and draws on colleagues from commercial, IP, privacy, regulatory, technology and VAT teams to give advice on the full range of e-commerce issues.

We have helped a large number of clients from a wide variety of economic sectors to address the risk, compliance and commercial issues associated with their online presence. As well as retailers setting up e-commerce operations, these include clients in telecommunications, bio-sciences, chemicals production and an industry group responsible for delivering Government initiatives in this area. In particular, we have an acknowledged strength in helping clients based in the US who need to address the question of cross border compliance.

Our e-commerce appointments include advice for Marks and Spencer plc, GAP Europe, Tiffany & Co, The Timberland Company,, Acer, Next plc, Wolverine, Revlon, Givenchy, and Kurt Geiger.

Our e-commerce experience

Experience

  • Advising M&S on regulatory compliance aspects of  their international online expansion in Europe, North America and Asia Pacific. 
  • Advising Rhapsody International on its acquisition of the Napster online music streaming and download business in Europe and on the terms for its new music streaming services for UK and Germany business.  
  • Advising a large US retailer on review conducted across 32 countries in Europe of applicable e-commerce regulation and risks.  We scoped the project, starting initially with 9 countries and then extending the reach to the remaining 23. The programme of work was delivered to a pre-agreed capped fee within budget. 
  • Assisting Wolverine, Timberland and Tiffany & Co with  online terms of use, terms of sale and privacy policies for their international websites. 
  • Advising on download terms relating to apps and mobile commerce offerings. 
  • Advising on compliance with new cookies rules across Europe. 
  • Advising on a privacy policy dealing with online behavioural advertising across 12 jurisdictions. 
  • Providing a US retailer with  advice on pricing and VAT treatment for its EU across multiple jurisdictions. 
  • Advising on competitions and promotions for Givenchy, Miss Pucci, Timberland, Kurt Geiger, ArtRebels, Flying A and many others in Europe and Asia. 
  • Advising a flag carrying airline on wide ranging ASA complaints relating to two separate high profile print and online promotions for flights. We prepared and submitted detailed responses leading to one complaint not being upheld and the other being dealt with on an informal basis. 
  • Advising on the contracts for supply of website development and hosting services, payment processing service.
