Practice notes

David is a Principal Associate based in our London office, specialising in commodities and shipping. David’s commodities practice is both contentious and non-contentious, covering commodities trading disputes, the regulation of commodities trading (in particular MAR, EMIR, REMIT and MiFID II) and commodities contracts. His shipping practice is principally disputes under contracts of carriage arising out of delay and damage to cargoes and vessels.

David is particularly experienced in relation to energy commodities and has completed two secondments to the shipping and trading arm of an oil major. He has twice been listed in the Legal 500 as a recommended individual for physical commodities (2014 and 2017). David’s recent experience includes:

  • Acting for an oil major in a High Court claim for hedging-related losses on an oil cargo arising out of vessel breakdown and delayed delivery.
  • Acting for the trading arm of a state-owned oil company in relation to defaults under a term contract with a refinery.
  • Acting for a phosphoric acid producer and shipper in an arbitration claim for damage to a chemical tanker.
  • For a Canadian oil company: drafting general terms and conditions for the sale of its crude and refined products; drafting a commodity derivatives trading compliance manual covering MAR, EMIR, authorisation exemptions and position limits; and delivering market abuse training.
  • Advising two European natural gas market participants on various aspects of REMIT compliance.
  • Market conduct training for an oil major’s London-based traders.
  • Acting for a European commodities and goods business in a dispute arising out of an alleged warehouse fraud affecting a chain of sale and purchase contracts.
  • Acting for a Swiss metals trader in an arbitration claim relating to misdelivery of a consignment of steel coils
  • Advising on coal sale and purchase and storage/handling contracts for a coal-fired power station.
  • Acting for a Swiss oil products trader in an arbitration claim arising out of the detention of a vessel by the Nigerian coast guard.
