Ben is a New Zealand-qualified associate specialising in energy, predominantly clean and renewable energy generation.

He is specialised in offtake & subsidy regimes, regulatory, grid and other commercial aspects of energy projects (in the UK and internationally). He has supported in the development, acquisition, disposal and financing of numerous energy projects, across a range of technologies (including nuclear, onshore and offshore wind, rooftop and ground based solar PV, battery storage, CHP, CCGT, biomass and AD/ACT), acting for a range of developers, funds, banks, financial institutions, energy services providers, and electricity end users.

His experience includes advising on:

  • power purchase agreements (including corporate PPAs) and trading arrangements
  • grid connections (including shared connections)
  • renewables support regimes (such as contracts for difference (CfDs), renewables obligation (RO), feed-in tariffs (FITs), net metering, and renewable heat incentives (RHI))
  • disputes and audits with the regulator (Ofgem)
  • supplier obligations (including under FIT, RO, ECO, WDH, Green Deal, Supply License Conditions, etc)
  • electricity act licensing and exemptions
  • ancillary and balancing services (such as capacity market (CM), including the suspension following the Tempus case and subsequent judicial review challenge, frequency response (FFR) and reserve services)
  • nuclear regulations (including nuclear liability channelling, site licensing, and radioactive waste management and transport regulations)
  • battery regulations (eg, end of life liabilities for collection and recycling)
  • flexible energy supply arrangements (including sleeving)
  • connection and supply arrangements for high demand users (including prominent datacentre providers)
  • other commercial, licensing, license exemptions and regulatory matters

Ben has also worked on a number of international independent power plant (IPP) projects, acting for sponsors, developers, utilities and governments, including advising on any applicable tariffs/subsidy schemes for renewables, regulatory issues, and the completion of power purchase agreements and concession agreements.

He has assisted in setting up other emerging structures such as corporate PPAs (including net metering, wheeling, sleeving, virtual and private wire arrangements), both in the UK and internationally.

Key clients include CGN, E.ON, Shell, Bayerische Landesbank, BlackRock, Greencoat Capital, Nuclear Decommissioning Authority, URENCO, Centrica, Rolls Royce, GlaxoSmithKline, National Grid, Greater London Authority (GLA), Thames Water, CNNC, Alfanar, Vattenfall, Engie, EDF, SSE, Severn Trent, Eggborough, Rockfire Capital, Gresham House, Sempcorp/UKPR, Iron Mountain, INEOS, Tata, Wärtsilä, Triodos Bank, HSBC, Santander, Standard Chartered Bank, and Waitrose/John Lewis in relation to a broad range of energy related matters.

He has worked on projects and on renewable programmes in many jurisdictions including:
