Commercial Professional Negligence

Wayne qualified in 1999 and is a Principal Associate in our Financial Services Dispute Resolution group. He has considerable experience of advising Banks and Building Societies on negligence claims against professionals (surveyors, solicitors, accountants etc) and advising on other avenues of potential recovery, including personal guarantees and recovery in corporate insolvency situations.

Wayne’s particular specialism is in Commercial professional negligence cases and claims arising from large portfolios both under commercial ownership or by individual buy-to-let landlords.

Commercial and complex negligence cases often arise as a result of fraud and Wayne have extensive experience of advising clients on alternative recovery options arising from fraudulent transactions.

Wayne also advises on title rectification claims involving the Land Registry and the courts where security taken by Banks and Building Societies is inadequate or void due to fraud.

Wayne has been the key advisor to Banks on several high value and complex claims for recovery in the High Court and the Court of Appeal.

Wayne and the team extensively use mediation and other alternative dispute resolution methods to promote settlement and avoid the need for trial.

Wayne has regularly delivered talks and training on various issues involving Banking disputes.

Life Sector disputes

Wayne specialises in, and has considerable experience of, advising clients in the Life sector on a broad spectrum of life, health and regulatory issues involving claims.

Wayne has advised Life Assurers about strategy and individual claims since 2002. He has given advice on all levels of disputes ranging from FOS complaints about individual life/critical illness to multi million pound Keyman death abroad disputes and has advised major assurer clients on judicial review challenges against the FSA/FOS.

Wayne regularly advises on policy disputes, non-disclosure and the impacts of recent legislation and regulatory changes on disputes.

He has advised on regulatory issues involving the FCA (and formerly the FSA) and advised extensively on strategic issues involving the Financial Ombudsman Service.
