Practice notes
He is a real estate litigator by specialism; as the former product group head of our real estate disputes team, he was part of the litigation practice group's senior management team for over 10 years.
Paul is the only property disputes lawyer in the West Midlands listed in the Legal 500 "Hall of Fame" ("partners who are at the pinnacle of the profession; having received constant praise from clients for continued excellence") and he has been recognised as a leading individual in both the main legal directories for many years. In recent times those directories have quoted Paul as being "a leading light in real estate litigation", "a great litigator with a fair and friendly manner" and as "exercising excellent judgement in a quiet and pleasant way". In the past, he has also been described as the "the friendly and outward-looking face of the practice"!!
He specialises in all types of complex property related disputes, and has a particular interest in dilapidations and rent review cases. Paul is a qualified CEDR mediator, the first solicitor appointed to the Arbrix committee and a member of the RICS Expert Witness Training Faculty.
Through the years Paul has worked with many of the firm's clients but he has always been particularly active in the retail and financial services sectors; much of his career since qualifying in 1993 has been spent advising and acting for retailers and leisure clients such as Claire's Accessories, Lloyds Pharmacy, Mitchells & Butler, Next, Nuffield Health and Wolseley. Paul also undertakes a lot of contentious real estate work on the retail estates of HSBC and Barclays.
Paul’s recent experience includes:
- Acting in court proceedings and in a mediation for a leisure operator against a claim arising from the emergence of a sink hole/collapse of a service road near Oxford FC
- Defending a retail tenant against a £2m dilapidations claim in respect of one of its former call centres
- Pursuing a claim for misrepresentation and defending a claim for service charge arrears for a retailer in respect of one of its key stores on Oxford Street
- Acting as part of the Eversheds Sutherland team in arbitration proceedings in respect of the UK’s largest multi £billion rent review dispute
- Advising a pub operator in a £multi-million claim arising from the forced closure of one of its key trading locations due to fear of collapse, in light of structural issues emulating from its landlord retained land
- Advising many clients upon lease and contractual termination issues arising in consequence of Covid
