Practice notes

Ciaran is a Consultant in our Financial Services Regulation & Governance Group. He has significant experience of advising Irish and international firms on a wide range of FS regulatory issues, such as CBI authorisations, corporate governance requirements, AML/CTF requirements, compliance with consumer protection requirements, on-going compliance with the applicable regulatory regime, regulatory investigations, Fitness & Probity.

Ciaran has particular experience in assisting firms to deal with potential/actual CBI investigations under the Administrative Sanctions Procedure (ASP) regime and assisting firms and individuals with issues that arise under the CBI’s Fitness & Probity regime.

Prior to commencing with Eversheds Sutherland, Ciaran was Deputy Head of Enforcement in the Central Bank of Ireland.

Ciaran also presents papers on governance and culture in financial services at conferences internationally and has contributed to a chapter of the recent book on “White-collar crime in Ireland: Law and policy”. He was recently invited to present a paper on “The role of the Board of financial services firms in improving the firm’s culture” at a conference in Seattle, which is to be published in the University of Seattle Law Review.

Ciaran is a qualified solicitor in both Ireland, England & Wales.

Some recent experience includes:

  • Advising a global bank on their internal governance processes and procedures in their Irish operations. He advised on the process for carrying out an evaluation of Board performance and carrying out a Board performance review.
  • Advising a number of firms on corporate culture issues, in the context of the Eversheds Sutherland Culture Review service (provided in strategic partnership with globally-renowned organisational culture experts, Denison Consulting).
  • Advising a financial services client in an investigation by the Central Bank of Ireland into the fitness & probity of an individual, and;
  • Advising a major financial institution in the context of an on-going Administrative Sanctions Procedure case brought by the Central Bank of Ireland against the firm.
